Les r\u00e9sultats \u00e0 cet effet sont pr\u00e9sent\u00e9s dans la section du rapport annuel consacr\u00e9e \u00e0 la planification strat\u00e9gique.<\/p>\n<p>La pr\u00e9sente section fait \u00e9tat des autres donn\u00e9es li\u00e9es aux op\u00e9rations de la Vice-pr\u00e9sidence de la division de la sant\u00e9 et de la s\u00e9curit\u00e9 du travail (SST) et de la Vice-pr\u00e9sidence des divisions des relations du travail, des services essentiels, et de la construction et de la qualification professionnelle (RT).<\/p>\n<h3><strong><br \/>\nInventaire des dossiers<\/strong><\/h3>\n<p>L\u2019inventaire des dossiers est constitu\u00e9 de tous les dossiers ouverts et en attente de fermeture. La grande majorit\u00e9 de ces dossiers sont en traitement, c\u2019est-\u00e0-dire qu\u2019une date d\u2019audience a \u00e9t\u00e9 fix\u00e9e, qu\u2019une audience a \u00e9t\u00e9 tenue, que le dossier est en d\u00e9lib\u00e9r\u00e9, qu\u2019une conciliation est en cours ou que le dossier a \u00e9t\u00e9 mis en suspens \u00e0 la demande des parties. L\u2019article\u00a045 de la <em>Loi instituant le Tribunal administratif du travail<\/em> (LITAT) pr\u00e9voit que, sous r\u00e9serve d\u2019une r\u00e8gle particuli\u00e8re pr\u00e9vue dans une loi, le Tribunal doit rendre sa d\u00e9cision dans les trois mois suivant la mise en d\u00e9lib\u00e9r\u00e9. Le dernier alin\u00e9a de l\u2019article\u00a0359 de la <em>Loi sur les accidents du travail et les maladies professionnelles<\/em> (LATMP) apporte une exception \u00e0 cette r\u00e8gle g\u00e9n\u00e9rale en pr\u00e9voyant un d\u00e9lai de d\u00e9lib\u00e9r\u00e9 de 60\u00a0jours pour les dossiers prioritaires.<\/p>\n<p>En ce qui a trait aux requ\u00eates en accr\u00e9ditation, le <em>Code du travail<\/em> pr\u00e9voit qu\u2019elles doivent \u00eatre trait\u00e9es en moins de 60 jours. Les dossiers urgents de la Division des relations du travail et de la Division de la construction et de la qualification professionnelle sont trait\u00e9s selon le degr\u00e9 d\u2019urgence de la situation.<\/p>\n<p>Le Tribunal calcule un d\u00e9lai moyen de d\u00e9lib\u00e9r\u00e9 qui englobe tous les dossiers ferm\u00e9s par d\u00e9cision au cours de l\u2019ann\u00e9e, peu importe leur niveau d\u2019urgence. Ainsi, pour la p\u00e9riode du 1<sup>er<\/sup> avril 2018 au 31 mars 2019, le Tribunal a enregistr\u00e9 48 plaintes dont 13 se sont av\u00e9r\u00e9es fond\u00e9es.<\/p>\n<p><strong>Une<\/strong> <strong>plainte fond\u00e9e<\/strong> requiert, lorsque possible, une intervention directe pour corriger la situation. Si elle ne peut \u00eatre corrig\u00e9e, des mesures sont prises afin qu\u2019elle ne se reproduise plus.<\/p>\n<p><strong>Une<\/strong> <strong>plainte est fond\u00e9e\u00a0en partie<\/strong> lorsque la responsabilit\u00e9 de la faute est partag\u00e9e entre la partie plaignante et le Tribunal, ou lorsque la position du Tribunal est en partie justifi\u00e9e.<\/p>\n<p><strong>Une<\/strong> <strong>plainte non fond\u00e9e<\/strong> est bas\u00e9e sur une incompr\u00e9hension et ne n\u00e9cessite aucune intervention de la part du Tribunal.<\/p>\n<p><strong>Une<\/strong> <strong>plainte irrecevable<\/strong> ne peut \u00eatre trait\u00e9e par le Tribunal parce qu\u2019elle ne remplit pas les conditions d\u2019ouverture.
